It is important to recruit staff in a way that does not contravene the legal rules that govern the recruitment process. The consequences of not complying with legislation can be damaging both in terms of adverse publicity for the Service and in the cost of someone bringing a successful case to an Employment Tribunal for unfair discrimination.

In addition Recruitment into the Prison Service is governed by the Civil Service Order in Council 1995. The Order in Council sets out the legal basis for all our Recruitment policies and practice. It requires the Civil Service Commissioners to provide a Recruitment code on the interpretation and application of the principles for Recruitment into the whole Civil Service including the Prison Service. The principles and the Code are mandatory and must be followed when any post is open to competition from outside the Civil Service.
